知乎，百度文库，Quora的用户协议简单对比

今天 twitter 中文圈里热门话题之一是知乎的用户协议。很多人认为是霸王条款，有人提议比较一下几个类似服务的用户协议，那么我挑几条知乎中最受诟病的条款出来比比。

以下绿字为知乎的条款，红字为百度文库的条款，蓝字为 Quora (知乎的克隆母体)的条款。

二 2、任何人或团体，包括新闻网站在内的任何媒体，均不得在没有事先获得相关用户或知乎的书面许可的情况下，复制、引用、转载知乎上的任何内容用于直接或间接的盈利目的。所有在知乎平台上产生的内容，被引用、转载时，一律必须注名出处，并给出原文 URL 连接。

权力提示 1.2) 百度文库的用户可以为介绍、评论、研究等目的，在合理的范围内适当引用他人已经发表的作品，但应当注明作者姓名、作品名称，并不得侵犯著作权人及其他权利人的合法权益。

使用条款 2. 用户从百度文库中获得的信息，未经事先许可，用户不得以盈利为目的自己或提供给第三方进行使用（符合法律规定的“合理使用”条件的除外）。否则，一切法律后果由该用户或第三方自负。

Subject to these Terms, Quora gives you a worldwide, royalty-free, non-assignable and non-exclusive license to re-post any of the Content on Quora anywhere on the rest of the web provided that the Content was added to the Service after April 22, 2010, and provided that the user who created the content has not explicitly marked the content as not for reproduction, and provided that you: (a) do not modify the Content; (b) attribute Quora with a human and machine-followable link (an A tag) linking back to the page displaying the original source of the content on quora.com (c) upon request, either by Quora or a user, remove the user’s name from Content which the user has subsequently made anonymous; (d) upon request, either by Quora or by a user who contributed to the Content, make a reasonable effort to update a particular piece of Content to the latest version on quora.com; and (e) upon request, either by Quora or by a user who contributed to the Content, make a reasonable attempt to delete Content that has been deleted on quora.com.

(大致：2010.04.22以后quora上的内容可以随意传播，不过有几个条件：原作者没有声明不准传播；传播时不得改动内容，需要添加原文链接，原作者有什么意见必须尊重等。)

二 3、对于用户发表到知乎上的任何内容，用户同意知乎在全世界范围内具有免费的、永久性的、不可撤销的、排他性的（除针对贡献相关内容的用户自身和直接得到该用户就该内容的授权的第三方）和完全再许可权的权利和许可，以行使和保护与内容相关的全部著作权，包括但不限于使用、复制、修改、改编、出版、翻译、据以创作衍生作品、传播、表演和展示此等内容（整体或部分），和/或将此等内容编入当前已知的或以后开发的其他任何形式的作品、媒体或技术中。如果任何第三方侵犯了与用户相关的著作权，用户均授权知乎及其指定的代理代表知乎自身或用户对该第三方提出警告、投诉、发起行政执法、诉讼、进行上诉，或谈判和解，并且用户同意在知乎认为必要的情况下参与共同维权。

权利提示1. 百度文库上的内容完全来自用户上传，百度并不对其进行任何编辑或修改。百度文库的用户不能侵犯包括他人的著作权在内的知识产权以及其他权利。一旦由于用户上传的文档发生权利纠纷或侵犯了任何第三方的合法权益，其责任由用户本人承担，因此给百度或任何第三方造成损失的，用户应负责全额赔偿。

使用条款6. 百度有权根据互联网的发展和中华人民共和国有关法律、法规及规范性文件的变化，不断修改和完善百度文库帮助的相关条款。百度保留随时修改文库帮助条款的权利。用户使用百度文库，即意味着同意并自愿遵守文库帮助所有条款及其最新版本。
